Supreme Court Says – Reconsideration of AGR Dues Allowed Only for Vodafone Idea

In a major relief for Vodafone Idea (VI), the Supreme Court of India on Tuesday clarified that only Vodafone Idea’s request for reconsideration of Adjusted Gross Revenue (AGR) dues will be taken up, while no similar relief will be extended to other telecom operators.

A bench led by Chief Justice D.Y. Chandrachud observed that Vodafone Idea’s case had certain unique financial circumstances that warranted a re-examination of its dues calculation. However, the court made it clear that the earlier 2019 AGR judgment remains binding for all other telecom companies, including Bharti Airtel and Reliance Jio, which have already cleared their dues or accepted the verdict.

The decision comes after Vodafone Idea sought a reassessment of its AGR liabilities, arguing that errors in the calculation inflated its dues by thousands of crores. The company claimed that the reassessment was critical to ensure its financial viability and continued operations in the telecom sector.

The Supreme Court, while agreeing to hear the plea, has asked the Department of Telecommunications (DoT) to submit a detailed report within four weeks, outlining the basis of dues computation and any potential discrepancies.

This partial relief could offer a crucial lifeline to the debt-ridden telecom operator, which has been struggling with mounting losses and heavy repayment obligations. Analysts believe a favorable outcome could improve investor confidence and stabilize the telecom market, which has been dominated by two major players — Reliance Jio and Bharti Airtel.

However, the court’s decision to limit the reconsideration exclusively to Vodafone Idea has sparked debate among industry observers, who question whether selective relief could create an uneven playing field in the sector.

The case will next be heard in December 2025, with the final outcome likely to have a significant impact on the future of India’s telecom landscape.
